TODAY THE MEMBERS VOTED TO APPROVE THEIR FINAL REPORT. AND THEY RECOMMENDED THAT THE DEPARTMENT OF JUSTICE CHARGE FORMER PRESIDENT DONALD TRUMP WITH FOUR CRIMES INCLUDING AIDING AN INSURRECTION. LISA DESJARDINS WAS IN THE HEARING TODAY AND JOINS ME FROM THE CAPITOL. LET'S START WITH THE NEWS, LISA. THESE CRIMINAL WERE FOUND THEM AND TO WHOM ARE THEY AIMED? LISA: LET'S LOOK AT THOSE FOUR CRIMINAL REFERRALS, RECOMMENDATIONS TO THE DEPARTMENT OF JUSTICE. FIRST, OBSTRUCTION OF AN OFFICIAL PROCEEDING. THAT'S FOR OBSTRUCTING THE
ACTUAL JANUARY 6 COUNT OF THE ELECTORAL VOTES BY CONGRESS. THEN, CONSPIRACY TO DEFRAUD THE UNITED STATES. THAT REFERS TO SEVERAL INSTANCES THE COMMITTEE SAYS, INCLUDING THE SO-CALLED BIG LIE, AS WELL AS THE IDEA THAT FORMER PRESIDENT -- FORMER VICE PRESIDENT PENCE COULD STOP THE ELECTORAL COUNT. NEXT, CONSPIRACY TO MAKE ALL STATEMENTS. THAT SPECIFICALLY IS ABOUT THE SCHEME AS THE COMMITTEE PUTS IT, TO TRY TO PUT FALSE ELECTOR SLATES ON THE BOARD, OVERTURNED THE ACTUAL ELECTORS FOR EACH STATE, AND FINALLY, ASSISTING AND AIDING OR COMFORTING AND INSURRECTION. THESE ARE ALL CLEARLY VERY SERIOUS CHARGES. HE'S NOT THE ONLY ONE GETTING A CRIMINAL REFERRAL FROM E JANUARY 6 COMMITTEE. ANOTHER TRUMP ALLY INVOLVED, ATTORNEY JOHN EASTMAN IS BEING REFERRED FOR TWO CHARGES, OBSTRUCTION AND CONSPIRACY. IN ADDITION TO HIM, THERE ARE THREE OTHER NAMES I WANT TO BRING UP, POTENTIAL CO-CONSPIRATORS THAT THE COMMITTEE SAID IT IS NOT
REFERRING FOR CHARGES, BUT IT IS CALLING THEM CO-CONSPIRATORS, BASICALLY SAYING THE DEPARTMENT OF JUSTICE SHOULD LOOK INTO THEM. MARK MEADOWS, AND RUDY GIULIANI, A WELL-KNOWN NAME, PRESIDENT'S FORMER ATTORNEY. TALKING ABOUT WHY THEY MADE THESE REFERRALS, AND UNDERSTANDING THIS IS UNPRECEDENTED IN U.S. HISTORY. HERE IS JAMIE RASK FROM THE COMMITTEE. >> WE UNDERSTAND THE GRAVITY OF EACH AND EVERY REFERRAL WE ARE MAKING TODAY, JUST AS WE UNDERSTAND THE MAGNITUDE OF THE CRIME AGAINST DEMOCRACY THAT WE DESCRIBE IN OUR REPORT. THEY ARE JUST SAYING THESE ARE THE CRIMES FOR WHICH THEY BELIEVE THERE IS INDISPUTABLE EVIDENCE THEY HAVE GATHERED. JUDY: WE KNOW THERE WERE OTHER LAWMAKERS WHO WERE NAMED IN THIS. FILL IN THAT PART OF THE STORY FOR US. LISA: LET'S LOOK AT THESE NAMES, THEY ARE BEING REFERRED FOR AN ETHICS INVESTIGATION. KEVIN MCCARTHY, JIM JORDAN, THE MAN WHO IS LIKELY TO BE THE HOUSE CHAIRMAN OF THE JUDICIARY COMMITTEE, REPRESENTATIVE SCOTT PERRY AND ANDY BIGGS OF ARIZONA. ALL FOUR OF THEM BEING REFERRED BECAUSE THEY REFUSED TO TESTIFY BEFORE THE COMMITTEE, EVEN THOUGH THEY WERE SUBPOENAED. THIS RAISES SOME PUSHBACK FROM REPUBLICANS. THEY SAY THE COMMITTEE IS POLITICAL, THAT IT HAS ALWS TARGETED ONE PARTY AND IS NOT
DONE ENOUGH TO LOOK AT THE SECURITY QUESTIONS INVOLVED. I SPOKE TO RODNEY DAVIS, HE WAS APPOINTED TO THE COMMITTEE AT ONE POINT, AND REFUSED TO SARE BECAUSE HE SAID NANCY PELOSI WAS TWO POLITICAL -- TWO POLITICAL AND REJECTING OTHERS FOR THAT COMMITTEE. >> NANCY PELOSI NEW WHEN SHE WAS GOING TO DENY FOR THE FIRST TIME IN OUR NATION'S HISTORY, SHE KNEW WHAT SHE WANTED, AND SHE IS GETTING WHAT SHE WANTED. THAT IS A ONE-SIDED REPORT. UNFORTUNATELY IT DOES NOTHING TO IMPROVE THE SECURITY APPARATUS HERE IN AND AROUND THE CAPITOL COMPLEX, IN MY OPINION. THE BIGGER PICTURE IT PAINTS. LISA: I THINK IF YOU'RE LOOK AT ASH IF YOU LOOK AT WHAT THEY'RE SAYING ABOUT FORMER PRESIDENT TRUMP, THERE ARE THREE BROAD CATEGORIES AND WHAT THEY ALLEGE. FIRST THEY ARE TALKING ABOUT THE BIG LIE ITSELF, SAYING FORMER PRESIDENT TRUMP, IT WAS PREMEDITATED IN SETTING UP THE IDEA THAT THE ELECTION COULD BE STOLEN AND THEN HE DID INDEED SAY IT WAS STOLEN EVEN THOUGH HE KNEW OTHERWISE. THE SECOND THING THEY ARE TALKING ABOUT IS PRESSURE CAMPAIGNS ON THE DEPARTMENT OF JUSTICE, FORMER VICE PRESIDENT PENCE, AND ELECTION OFFICIALS ACROSS THE COUNTRYN STATES. AND THE BIG CRUX OF THE REPORT IS TALKING ABOUT THE PRESIDENT'S REFUSAL TO STEP IN AND TRY AND TELL THE CROWD TO STOP ON JANUARY 6. IF YOU LOOK, THAT WAS PART OF THE VIDEO THE COMMITTEE SHOWED TODAY IN ITS SUMMARY, HIGHLIGHTS . SHE'S ALSO A FORMER JUSTICE DEPARTMENT OFFICIAL. AND JAMIL JAFFER, A LAW PROFESSOR AT GEORGE MASON UNIVERSITY AND FORMER ASSOCIATE COUNSEL TO PRESIDENT GEORGE W. BUSH. HELLO TO BOTH OF YOU. YOU WERE HERE WITH US TODAY WE COVERED THE LIVE COMMITTEE MEETING. I WILL START WITH YOU, MARY. WHAT IS THE OVERALL SIGNIFICANCE OF WHAT WE'VE SEEN OVER THE COURSE OF THESE 18ONTHS AND TODAY'S RECOMMENDATIONS? MARY: WE'VE SEEN A MASSIVE INVESTIGATION AND BRINGING TOGETHER SO MUCH EVIDENCE, TESTIMONY, MANY OF THOSE HEARINGS ALWAYS IN THE STUDIO WITH YOU, TWO HOURS AND SOMETIMES THREE HOUR HEARINGS. THAT HAS ALL CULMINATED IN REPORT AND OF COURSE WE HAVEN'T SEEN THE FULL REPORT, BUT EVEN JUST THIS EXECUTIVE SUMMARY REALLY PAINTS A PICTURE THAT
THIS WAS NOT A ONE-OFF, THIS WAS NOT A SPONTANEOUS DEMONSTRATION AT THE U.S. CAPITOL THAT TURNED VIOLENT. THIS WAS A CONCERTED EFFORT BY A NUMBER OF PEOPLE, STARTING EVEN BEFORE THE ELECTION, AND IT BUILT THROUGH THESE MULTI-FACETS OF THE CONSPIRACY AS LISA WAS JUST DISCUSSING BETWEEN THE BIG LIE, TO THE PRESSURE CAMPAIGN AND ULTIMATELY TO THE VIOLENCE. WHAT IS SO UNPRECEDENTED IS ACTUALLY MAKING RECOMMENDATIONS TO THE DEPARTMENT OF JUSTICE TO BRING CRIMINAL CHARGES AGAINST THE FORMER PRESIDENT OF THE UNITED STATES. WE HAVE NOT SEEN THAT IN OUR HISTORY, BUT IT SHOWS HOW STRONGLY THEY FEEL AND HOW MUCH ACCOUNTABILITY IS IMPORTANT HERE. JUDY: HISTORICALLY WE HAVEN'T SEEN THIS BEFORE. WHAT IS YOUR SENSE OF WHAT THIS REPORT IN THESE REFERRALS SAY TO US RIGHT NOW?
>> I THINK THEY TELL US A STORY ABOUT WHAT HAPPENED ON JANUARY 6, AND THE LEAD UP TO THE EVENTS OF THAT DAY. AND THE TROUBLING ROLE THAT THE FORMER PRESIDENT OF THE UNITED STATES PLAYED IN THOSE EVENTS, STOKING THEM, ENCOURAGING THEM AND ULTIMATELY BRINGING ABOUT WHAT HAPPENED BY CALLING PEOPLE TO LEAVE THE ELLIPSE WHERE HE WAS SPEAKING TO THEM AND TO TRAVEL UP TO THE CAPITOL, KNOWING THEY WERE ARMED. OBVIOUSLY AROUBLING SET OF CIRCUMSTCES, ENOUGH OF THE CONGRESS TO RECOMMEND THESE CRIMINAL CHARGES. WHAT IS INTERESTING IS CONGRESS ALSO SOUGHT TO IMPEACH THE PRESIDENT PREVIOUSLY. THEY ULTIMATELY HAD A MAJORITY OF VOTES IN THE SENATE BUT NOT ENGH TO CONVICT. THE QUESTION NOW FOR THE COUNTRY IS, WHAT HPENS NEXT? THE FORMER PRESIDENT IS RUNNING AGAIN, SO THE AMERICAN PEOPLE WILL HAVE A CHANCE TO WEIGH IN ON THAT, FIRST IN THE REPUBLICAN PRIMARIES AND THEN AGAIN IN THE GENERAL ELECTION IF HE IS THE NOMINEE OF THE REPUBLICAN PARTY.
JUDY: WE KNOW THE DEPARTMENT OF JUSTICE IS ALREADY LOOKING INTO SO MUCH OF THIS. WHAT WILL BE DIFFERENT AND WHAT THEY CAN DO AS THEY LOOK AT THESE REFERRALS? MARY: THE DEPARTMENT OF JUSTICE WILL BE EAGERLY LOOKING THROUGH EVERYTHING THE COMMITTEE PROVIDES TO THEM. THEY HAVE ALREADY IMPANELED A GRAND JURY, A BODY OF COMMUNITY MEMBERS WHO REVIEW THE EVIDENCE PRESENTED AND ULTIMATELY ARE THE PEOPLE WHO WILL DECIDE WHETHER TO VOTE TO RETURN AN INDICTMENT. IN THE COURSE OF PRESENTING EVIDENCE TO THE GRAND JURY, THE DEPARTMENT OF JUSTICE CAN SUBPOENA ADDITIONAL WITNESSES, INCLUDING PROBABLY MANY OF THOSE WHO TOOK THE FIFTH AMENDMENT IN FRONT OF THE COMMITTEE. IF THE DEPARTMENT AGREES WITH THEIR ASSERTION OF THE FIFTH AMENDMENT, THEY CAN APPEAL TO A JUDGE SAYING WE DON'T THINK THE PERSON -- THEY SHOULD HAVE TO TESTIFY. THEY ALSO HAVE THE POWER IF THEY SEE FIT TO GRANT IMMUNITY TO A WITNESS IN ORDER TO OBTAIN TESTIMONY.
THEY CAN ISSUE SEARCH WARRANTS ON PROBABLE CAUSE. THERE ARE MANY THINGS THEY CAN DO THAT THE COMMITTEE DID NOT HAVE THE SAME POWER TO DO. JUDY: SO THEY HAVE SOME DIFFERENT TOOLS. ALSO, WHAT IS THE STANDARD FOR DETERMINING WHETHER SOMETHING NOT ONLY IS CRIMINAL, BUT THERE IS ENOUGH EVIDENCE TO GO FORWARD AND PROSECUTE? >> IT'S A GREAT QUESTION. PROSECUTORS MAKE THESE ASSESSMENTS ALL THE TIME. IN THIS CASE THE ATTORNEY GENERAL HAS APPOINTED A SPECIAL COUNSEL TO MAKE THAT EVALUATION. TO MAKE THAT JUDGMENT AND DECIDE WHETHER TO BRING CHARGES. THERE IS A LOT OF EVIDENCE HERE, BUT THE QUESTION IS, IS IT ENOUGH TO BRING A CASE AND GET A CONVICTION? OF COURSE THE JUSTIC DEPARTMENT WANTS TO AVOID BEING VIEWED AS POLITICAL AND ANYTIME YOU'RE PURSUING A PRESINT OR HIS CLOSE ASSOCIATES ON CRIMINAL
CHARGES, THERE WILL ALWAYS BE THAT CHALLENGE, AND WE KNOW THAT IS ALREADY COMING FOR THE PRESIDENT AND THE FOLKS AROUND HIM. JUDY: ARE THE CRITERIA DIFFERENT FOR THE JUSTICE DEPARTMENT IN DECIDING WHAT SHOULD BE PROSECUTED AND WHAT SHOULD NOT? MARY: IT IS CERTAINLY DIFFERENT FOR WHAT IT NEEDS TO MAKE A REFERRAL. YOU CAN PURSUE AN INDICTMENT BASED ON PROBABLE CAUSE. IT IS NOT BEYOND REASONABLE DOUBT AT THIS STAGE. BUT THAT IS NOT THE LEVEL OF PROOF YOU WANT, BECAUSE TO GO ON TO TRIAL, YOU NEED PROOF BEYOND A REASONABLE DOUBT OF EVERY ELEMENT OF EVERY CRIME CHARGE. SO THE GUIDELINES ARE THAT YOU DON'T BRING A CASE UNLESS YOU BELIEVE YOU CAN MEET THAT STANDARD, THAT YOU HAVE ADMISSIBLE EVIDENCE THAT WILL MEET THAT STANDARD BEYOND A REASONABLE DOUBT, AND ALSO IF THERE IS AN IMPORTANT FEDERAL INTEREST. HERE IT IS PRETTY OBVIOUS THERE IS AN IMPORTANT FEDERAL INTEREST. JUDY: HOW ARE THE CRITERIA GOING TO BE DIFFERENT WHEN THOSE FINAL DECISIONS ARE MADE AT JUSTICE?
>> THE ONE THING THAT IS DIFFERENT HERE IS THE POLITICAL LAYERING ON TOP OF IT. THE PRESIDENT AND ATTORNEY GENERAL CHALLENGE HERE, KNOWING IT HAS ALREADY BEEN POLITICIZED BY THE FORMER PRESIDENT AND THE FOLKS WHO CONTINUE TO SUPPORT HIM. NOW THE QUESTION BECOMES WILL THE COUNCIL MAKE INDEPENDENT JUDGMENTS AND WILL THEY BRING E CHARGES ULTIMATELY? JUDY: ONE OF THE QUESTIONS IS, HE IS RUNNING FOR PRESIDENT, DOES THAT GIVE HIM A LAYER OF PROTECTION? MARY: THIS ATTORNEY GENERAL HAS BEEN CLEAR SINCE THE VERY BEGINNING IN THE INVESTIGATION THAT THEY WILL FOLLOW THE FACTS AND EVIDENCE WHERE IT LEADS, NO MATTER HOW HIGH. IT HAS POLITICAL SIGNIFICANCE IN THE DEPARTMENT WILL BE WORRIED ABOUT THAT. BUT THIS ATTORNEY GENERAL'S REPORT WILL GO TO THE ATTORNEY GENERAL. THE ATTORNEY GENERAL WILL
ULTIMATELY MAKE THE CALL. IF THE EVIDENCE IS SIGNIFICANT ENOUGH, IT WILL BE DIFFICULT TO SAY NO. JUDY: IT IS PART OF THE PROCESS, WE MAY NOT HEAR AS MUCH ABOUT WHAT IS GOING ON AS THE COURSE OF DECISION-MAKING TAKES LACE THERE. LOWER COURTS HAD ORDERED THE PANDEMIC-ERA POLICY, "TITLE 42", TO CEASE THIS WEDNESDAY. REPUBLICAN OFFICIALS IN 19 STATES CHALLENGED THAT ORDER. ROBERTS' MOVE IS TEMPORARY, WHILE THE FULL SUPREME COURT CONSIDERS THE CASE. JURY SELECTION BEGAN IN WASHINGTON TODAY, IN THE JANUARY 6TH TRIAL OF ENRIQUE TARRIO, THE FORMER "PROUD BOYS" NATIONAL CHAIRMAN. HE AND 4 OTHERS ARE CHARGED WITH SEDITIOUS CONSPIRACY.
DEFENSE LAWYERS WANTED A DELAY UNTIL AFTER THE CONGRESSIONAL JANUARY 6TH REPORT COMES OUT. THE JUDGE REFUSED. THE FBI IS WARNING OF A SPIKE IN ONLINE SEXUAL EXTORTION OF TEEN-AGE BOYS. THE BUREAU ESTIMATES AT LEAST 3,000 TEENS WERE TRICKED THIS YEAR INTO SENDING EXPLICIT PICTURES OF THEMSELVES, AND THEN, BLACKMAILED. THE SCAMS ARE LINKED TO MORE THAN A DOZEN SUICIDES.
