We are. Yeah. The U.S. Constitution lists three qualifications for a member of the House of Representatives. Twenty five years old a U.S. citizen and have it in the state that elected him or her. Victor Berger from Milwaukee met those criteria and in 1910 he became the first socialist congressman in America. But his opposition to U.S. involvement in World War 1 and the Red Scare of the time created problems for Berger in 1999 was convicted under the Espionage Act but he appealed a decision soon after Congress denied Berger his House seat citing his conviction as a reason. Despite the fact that this case was still under appeal his district reelected him but again he was denied his seat after the Supreme Court reversed his conviction.
