- Cassette No. 1 for October, 1971 Side A (con't) Code: 10711 INFORMATION HIGHLIGHTS/STUDY GUIDE Program: The President Announces his Supreme Court Nominations Principal: President Richard M. Nixon Recorded: October 21, 1972 at the White House Time: 14:30 Topic Outline 1. THE PRESIDENT'S CRITERIA FOR SELECTING SUPREME COURT NOMINEES ... "These are the criteria I believe should be applied in naming people to the Supreme Court. First, the Supreme Court is the highest judicial body in the country. Its members, therefore, should above all be among the very best lawyers in the nation"... "and the second consideration is the judicial philosophy of those who are to serve the Court." 2. NIXON DEFINES JUDICIAL PHILOSOPHY ... "By judicial philosophy I do not mean agreeing with the President on every issue ... it is my belief that it is the duty of a judge to interpret the Constitution, and not to place himself above the Constitution or outside the Constitution. He should not twist or bend the Constitution in order to perpetuate his personal, political, and social views." 3. PUBLIC ATTITUDE TO SUPREME COURT DECISIONS ... The President contends that every citizen has a right to disagree with the decisions of the Court. "But," he adds, "after those decisions are handed down, it is our obligation to obey the law whether we like it or not. And it is our duty as citizens to respect the institution of the Supreme Court of the United States."
